These Terms of Service ("Terms") govern your access to and use of the Eight dating app (the "App") and all related services provided by Eight Dating ("Eight", "we", "us", or "our"). By registering an account or using the App, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the App.
You must be at least 18 years old to use Eight. By registering, you confirm that you are 18 or older. We verify your age during onboarding via your date of birth. If we discover that a user is under 18, we will immediately terminate their account.
You must have the legal capacity to enter into a binding contract in your jurisdiction to use Eight.
You must not have had a previous Eight account that was terminated for violating these Terms.
You agree to provide truthful, current, and complete information at registration, including your real first name, date of birth, phone number, and email. Eight is a real-identity platform — using false information, impersonating another person, or creating fake profiles is strictly prohibited.
You are responsible for the security of your account credentials. You agree to notify us immediately at support@eightdating.com if you suspect unauthorised access. We are not responsible for losses resulting from unauthorised use of your account.
Each user may only maintain one active account. Creating multiple accounts is prohibited.
All submitted photos and verification videos are reviewed by the Eight team before the profile is visible to other users. We reserve the right to reject any profile that does not meet our Community Guidelines.
You agree to use Eight respectfully and lawfully. You may not:
Violations may result in immediate suspension or termination of your account.
You may only upload photos and videos that:
As part of onboarding, you must record and submit a short profile video. This video is reviewed by our team and used to verify that you are a real person. The video will be displayed on your profile to other users.
By uploading photos or videos, you grant Eight a non-exclusive, worldwide, royalty-free licence to store, display, and deliver your media solely to operate the App. We do not sell your media to third parties. You retain ownership of your content.
You can send "Smiles" to other users to show interest. Mutual Smiles create a Match. Super Smiles are a premium feature that gives your smile greater visibility and are subject to quota limits.
When two users send each other smiles, a Match is created. Matched users can start video calls through the App. Video calls are powered by Agora's real-time communication infrastructure.
Your profile becomes visible to other users after being approved by our review team. We may remove your profile from visibility at any time if it is deemed to violate these Terms.
Eight offers premium subscriptions (weekly, monthly, 3-month) that unlock additional features, including greater visibility and Super Smile quotas. Subscription prices are shown in the App before purchase.
The following consumable and one-time products are available:
All payments are processed by RevenueCat via the Apple App Store or Google Play Store. By purchasing, you agree to the payment terms of the relevant store.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Manage or cancel your subscription through your App Store or Google Play account settings.
All purchases are subject to the refund policies of the Apple App Store or Google Play. We do not process refunds directly. Consumable items (e.g., Super Smiles) that have been used are not refundable.
When a free trial period is offered, it will convert into a paid subscription at the end of the trial period unless cancelled in advance.
You can report any user you believe is violating these Terms or our Community Guidelines. We will investigate all reports and take appropriate action, which may include warning, suspending, or permanently banning the reported user.
You can block any user at any time. Blocked users cannot see your profile or interact with you.
We reserve the right, but not the obligation, to monitor, review, or remove any content or user at our sole discretion, without prior notice.
You can delete your account at any time through the App settings. After deletion, your profile, photos, and videos will be removed from the App. See our Privacy Policy for details on data retention.
We reserve the right to suspend or permanently terminate your account, with or without notice, if:
Account termination does not entitle you to any refund of unused subscriptions or in-app purchases.
All content, design, code, trademarks, and branding in the App are owned by or licensed to Eight. You may not reproduce, distribute, or create derivative works from any Eight materials without our prior written consent.
You retain ownership of the photos, videos, and information you submit. By submitting content, you grant Eight the limited licence described in Section 4.3.
Eight does not guarantee that you will find a romantic partner, that you will match with any particular user, or that you will have any specific experience using the App.
Eight is not responsible for the conduct of its users, online or offline. We strongly encourage users to exercise caution when meeting people they have met through the App.
The App is provided "as is" and "as available". We do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue features or the entire App at any time.
To the maximum extent permitted by applicable law, Eight and its affiliates, directors, employees, and agents will not be liable for:
Our total liability to you in connection with the App will not exceed the amount you paid to Eight in the 12 months prior to the event giving rise to the claim, or €50, whichever is greater.
You agree to indemnify and hold harmless Eight and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and costs (including legal fees) arising out of or related to:
These Terms are governed by the laws of Portugal, without regard to its conflict of laws provisions. Any disputes arising out of or related to these Terms or the App will be subject to the exclusive jurisdiction of the courts of Portugal, except where otherwise required by applicable consumer protection law in your jurisdiction.
If you are an EU consumer, you may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after the updated Terms are published constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the App and delete your account.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eight regarding your use of the App and supersede all prior agreements relating to the same subject matter.
